Powers of Attorney

Need to give someone you trust the authorisation to carry out certain activities on your behalf? This is the document that makes it possible.

In Trinidad and Tobago, Powers of Attorney must be drafted by a practising attorney-at-law and registered at the Registrar General’s office.

The procedure is smooth and effortless. Here’s how it works:

  • The donor-who bestows the power-appoints the  donee, or attorney, but this doesn’t mean the person you choose has to be a lawyer. In most cases, it’s a family member or good friend.
  • People generally turn to Powers of Attorney if illness or rigorous medical treatments render them physically unable to handle their affairs on their own, or if they will be abroad for long periods of time and need someone to keep on top of normal business transactions for them, such as paying bills, or making investments and currency transfers.

  • There are two types of powers of attorney—general and special or limited. We can explain which one is better suited to your needs, as well as prepare and register it for you.
  • Powers of Attorney immediately cease if the donor terminates the arrangement, dies or becomes mentally incapacitated.  It is important to note that currently, under Trinidad and Tobago law, the concept of a durable power of attorney—meaning one that remains valid after the maker becomes mentally incapacitated—does not yet exist.
